Student sues TARC over molest, rape bid

KUALA LUMPUR (April 10, 2008): A student who was molested, assaulted and nearly raped by a Tunku Abdul Rahman College (TARC) security guard filed a suit today against the college for negligence.

The 20-year-old former Diploma in Business Studies (Accounting) programme student is seeking RM5 million in general damages and RM3 million in punitive and exemplary damages from TARC.

The woman, whose name is withheld to protect her identity, filed the writ of summons with the High Court registry through Messrs Cheow Wee.

She is seeking an order that TARC support all her medical expenses and another order that the college support the costs of a study course, equivalent to the one she was pursuing, until completion, in another institution of her choice.

According to her statement of claim, she was walking towards an exit gate at the back of the campus after completing an examination at about 5.30pm on April 21, 2007, when she was attacked from the back by a man who wore a security guard’s uniform.

Her attacker, a juvenile, has since been convicted in a juvenile court after admitting to ­outraging her modesty, causing hurt using a weapon and attempting to rape her. He was sent to Henry Gurney School for three years.

The woman said as a result of the attack, she sustained injuries to her head and other parts of her body.

She said the attack took place in the campus and was committed by a security guard who was employed by the college or working on its behalf.

She alleged TARC had failed in its responsibility towards her, by committing ­negligence in ensuring her safety, as a student of the college.

The woman further alleged the defendant had failed to take sufficient and reasonable steps to ensure the safety of students in the campus and also ensure that all the security guards, who were employed by the college or on its behalf, ­behaved well and were qualified to work as ­security guards.

A copy of the document has not been served on the defendant.
